WICHITA, Kan. (AP) _ Lawyers for a Kansas doctor linked to 58 accidental overdose deaths want a judge to disqualify a federal
prosecutor and an agent from the case.
The defense for Dr. Stephen Schneider argues the prosecutor and an investigator violated professional ethics by improperly contacting defense expert witnesses and lying to the court.
The defense motion filed Monday in federal court in Wichita also asks the court for an evidentiary hearing or sworn depositions to investigate the alleged incidents.
The U.S. attorney's office declined to comment, saying it will file its response to the court.
Schneider and his wife, nurse Linda Schneider, are charged in a 34-count indictment with directly causing four deaths and contributing to 21 others of patients at the Haysville clinic.
