Judge Refuses to Gag Kansas Doctor's Defense

WICHITA, Kan. (AP) _ A federal judge has denied the government's efforts to gag defense attorneys, family and supporters of a Kansas doctor accused of unlawfully prescribing medication.

U.S. District Judge Monti Belot issued an order Thursday saying the government has not shown there is a compelling government interest in restraining speech.

He says an impartial jury can be seated in the case of Dr. Stephen Schneider and his wife by questioning potential jurors about their exposure to pretrial publicity.

Belot also denied the prosecution's request that the defense turn over a recorded statement the doctor made in jail. Defense attorneys told the judge only The Associated Press has the recording.
