A sidewalk porta potty is causing a "stink" between a Topeka Bike Shop owner and the city.

Jerry Morgan, owner of Jerry's Bike Shop, is in a code violation fight with the city over a Johnny on the Job.

Developers gave Morgan the porta potty because they took out his sewer line while digging in the area.

But, the city cited him because it seems only the developer doing construction can have porta potties, not a business.

This one is sitting on the sidewalk, another code violation..

Morgan wouldn't talk on camera, saying he's working with the city in hopes of finding a mutually satisfactory agreement.

Meantime, Morgan is also battling a year-old lawsuit filed by the Washburn Lane parkway renovation group.

The group claims Morgan violated a 2006 contract to move his bike shop to a new location.

The next court action is June 6th.
