Kline Needs Reveiw of Motions Against Planned Parenthood

OLATHE, Kan. (AP) _ Johnson County District Attorney Phill Kline has been barred from filing motions against Planned Parenthood without letting the judge review them first.
District Judge Stephen Tatum said Thursday he was imposing the review process "as a safety mechanism.'' He took the unusual step after Planned Parenthood attorneys accused Kline of attaching a document under court seal to a motion he filed this week.
Planned Parenthood attorneys asked for a hearing after an April 2007 court ruling from a Shawnee County judge became public. The document said Kline had the authority to transfer Planned Parenthood records he had obtained while state attorney general to the Johnson County district attorney's office.
Kline contends the document was not under seal.

Planned Parenthood attorneys must submit their legal motions to a Johnson County judge for review before filing them, just as District Attorney Phill Kline has been ordered to do, the judge said Friday. District Court Judge Stephen Tatum said he set up the review process for both sides during a court hearing Thursday held at the request of Planned Parenthood attorneys. The attorneys called for the emergency hearing to ask Tatum to discipline Kline for attaching what they said was a sealed court document to a motion that Kline filed Monday. Tatum declined to hold Kline in contempt of court or to sanction Kline by dismissing his case against Planned Parenthood, as Planned Parenthood attorney Pedro Irigonegaray requested.
