Testimony ended today in the second trial of two former Westar Energy executives charged with looting the Topeka utility.
The case against David Wittig and Douglas Lake is expected to go
to the jury next week in US.. District Court. The trial began ten weeks ago with jury selection.
The parties are getting a few days off before prosecutors give their closing arguments next Tuesday, followed by the defense on Wednesday.
Wittig is the former CEO of Westar and Lake is the former chief strategy officer. Their first trial ended last year with jurors undecided on about half the 40 counts against them.
Prosecutors say Wittig and Lake enriched themselves through
millions of dollars of inflated salary, stock options and other benefits including use of company airplanes. The defense argues that the actions were legal and approved by the Westar board.
