Lawsuit Filed Against the City of Topeka Save Email Print

Major news breaking Friday in the city of Topeka.

District Attorney Robert Hecht has filed a lawsuit against the city over its deal to buy a police helicopter.

Hecht says he has to fulfill Kansas law and that he had three major areas of contention.

At a press conference Friday Hecht said the city broke Kansas law when entering into the purchase agreement. Hecht disputed the council's use of a communication authorizing the purchase and said it violated governmental checks and balances in okaying the deal as to the expense of a suit…

"I wouldn't anticipate that this would be a very expensive process for the city of Topeka, although knowing the city of Topeka they have a way of being able to spend more money then anybody would anticipate,” Hecht said.

Topeka mayor, Bill Bunten hopes the suit will ensure that both sides are heard, “My position is simply that the D.A. will argue his position the city attorney will argue his position and a judge will make a decision as far as who is correct and will abide by that decision. "

"The litigation will proceed in an orderly fashion and we hope the court will ultimately agree with the position of this office and I would not anticipate that there would be a decision on this for a number of months,” Hecht added.

Other city leaders say they need time before they can respond.

"We just got the document, we will have to thoroughly review it and respond,” City Manager, Norton Bonaparte said Friday.

Topeka is much bigger than 29th St. My curbs are being redone throughout my entire neighborhood. Oh yeah and people are complaining because they are blocking some of their parking to replace the curbs. This city needs to quit complaining and take that energy to do stuff. Rome wasn't built in day. It took years for our city to fall apart it's going to take years to rebuild it. Why blame the city manager. These problems started way before him. City Council is made up of people from Topeka. They too must follow the laws. Who are we to say which cases should be heard. Email your city council people and tell them what you think. They are supposed to work for their disctrict.

I'm in agreement with the mayor and the district attorney. By trying to get around the mayor's veto, the five council members who are the usual suspects created a weird "communication to the city manager." This is absurd, trying to buy a second helicopter via a never-before-used method every bit as creative and unlawful as Enron's accounting. Rock on, Mr. Hecht!

Kick that city manager out of this city, overpaid dude has done nothing to curb the wild spending. Hey dude, drive straight down 29th street and see if it need to be overlaid with new topping.

Lest ye forget Ron Miller and his deparment. Here's a man who can't catch the bad guys that broke into his own home, but needs an 'air force' to not catch them here? Hecht may have questionable grounds with which to bring this suit, but Bonaparte & Company stepped way out of bounds to buy the 'Helicoptor nobody wants'. And just weeks after they wasted $4m on a $1m software suite. Now they want to raise sales tax just to fix curbs. I've about had it with this city manager form of extortion and I want Hecht to put a stop to it.

I think Hecht just needs to mind his own business and prosecute cases for the district court and stay out of city politics. Too many of these prosecutors thik they needs to be in everyone elses business. The judge needs to put Hecht back in his place which is prosecuting criminal cases and not worrying about city politics.

Good for the the District Attorney's office in filing a lawsuit against the City of Topeka. Norton Bonaparte was not a good pick for Topeka - Howard Giles was not a good choice either. What is wrong with the City of Topeka Council members and why do they assume they have so much power to do whatever they want and not be held accountable for their actions?
