TOPEKA, Kan. (WIBW) -- Topeka Police captured a break-in suspect Friday after the man climbed a tree and refused to come down.

Shawnee County dispatch told 13 News that a break-in was reported at Regency Inn, 3802 SW Topeka Boulevard, at 3:45 Friday morning.

The suspect fled the scene into a nearby wooded area, climbing almost 50 feet into a tree where he was spotted by the Kansas Highway Patrol helicopter. A K-9 unit on the ground was able to track the suspect's scent on the ground below.

After climbing halfway down the tree, the suspect told authorities he couldn't get down. As the Topeka Fire Department was called in, the suspect found a way down and was taken into police custody around 6:30 a.m.

13 News was there as it happened to capture exclusive video.

The suspect was identified Friday morning as Kevin Wayne Smith, age 30 of Topeka. He was booked in to DOC for Aggravated Burglary, Theft, Criminal Damage, and Felony Obstruction, police said.

Jail records show Kevin Smith had several theft convictions in Geary County and had recently violated is parole in Shawnee County.
