TOPEKA, Kan. (WIBW) - One of the four people accused in a 2010 murder outside Topeka West High School will not be able to withdraw his guilty plea.
Shawnee County District Court Judge Evelyn Wilson made the ruling Tuesday against Coty Newman. Wilson ruled Newman failed to demonstrate good cause to withdraw his plea.
Last March, Newman pleaded guilty to first degree murder and attempted second degree murder in the October 2010 shooting death of Matthew Mitchell and the wounding of another juvenile. He argued his prior attorney, Jon Whitton, was ineffective and told him he could change his plea at any time.
A dentencing date will be scheduled next week.
