TOPEKA, Kan. (WIBW) - The fight over whether Topeka attorney Billy Rork can represent a home invasion suspect isn't over.
Shawnee County District Court Judge Mark Braun canceled a Tuesday hearing and instead issued a two-page order, denying Rork's request he be allowed to serve as Monroe Lockhart's attorney. Braun upheld his ruling from March that Rork had a conflict of interest, since he also had represented a former co-defendant in the case, Anthony Talbert.
Rork argues the conflict no longer exists, since Talbert no longer faces charges for the November incident. Lockhart is accused of a home invasion in which a woman was beaten and burned. Another co-defendant, Jacob Barnett, testified against him.
Tuesday afternoon, Rork filed a motion asking Braun to reconsider the ruling and schedule a hearing on the matter. Rork argues Lockhart has a right to the attorney of his choosing.
