EMPORIA, Kan. (WIBW/KVOE) - The Lyon County Attorney plans to retry a man sentenced to life in prison for the 2009 shooting death of another man.
Jimmy Dominguez was convicted of premeditated first degree murder in the death of 25-year-old Jose Arroyo and handed a sentence with no chance of parole for 50 years.
Last week, the Kansas Supreme Court struck down both the "Hard 50" term and the conviction. KVOE reports the Court cited jury instruction mistakes for considering felony murder as an alternate count.
A new trial date has not been set, according to KVOE.
