TOPEKA, Kan. (WIBW)-- A Topeka man who killed another man outside a bar in 2008 will get a new trial.
James Qualls received a life sentence with no parole for 25 years in his 2010 trial. He is convicted of killing Joseph Beier in a fight over a pool game at the Whiplash Bar. Beier was shot 11 times.
Qualls immediately appealed his premeditated murder conviction, saying the judge should have instructed the jury on a lesser charge of voluntary manslaughter. The Kansas Supreme Court Friday agreed and sent the case back to Shawnee County District Court, ordering a new trial for Qualls.
