TOPEKA, Kan. (WIBW) - A $10 million lawsuit against Shawnee County has been dismissed because the plaintiff died.

51-year-old Claybon John McGlory said he didn't receive adequate treatment for his cancer while in jail.

Court records indicate he was booked into jail last March on a charge of drug possession.

A "suggestion of death" was filed on March 13, 2013. The motion to dismiss was granted July 5th.
