GEARY COUNTY, Kan. (WIBW) -- A hearing for the suspect at the center of an officer-involved shooting in Junction City has been continued.

Stefon Butler, 25, of Junction City, is charged with two counts of Aggravated Assault on a Law Enforcement Officer, Obstructing the Legal Process or Official Duty, Criminal Use of Weapons, Criminal Possession of a Firearm by a Convicted Felon and Possession of Stolen Property.

The charges stem from an incident at Club Eve, a nightclub on South Washington Street in Junction City.

At 2 AM on Sunday, May 13, 2012, Geary County Sheriff’s Department deputies were helping Junction City Police Department officers monitor the parking lot of the club at closing time.

A disturbance broke out and officials say Butler fled behind the building where deputies from the Sheriff’s Department were located. Geary County Undersheriff Tony Wolf said Butler pulled out a gun in an “aggressive manner” and was shot one time in the lower chest/upper abdomen by a female deputy. He has since recovered from his injuries.

The Kansas Bureau of Investigations investigated the incident and found that it was a justifiable use of force by the deputy. The Geary County Attorney also reviewed the case and came to the same conclusion.

Once the investigation was over, a warrant was issued for Butler’s arrest.

Butler’s preliminary hearing was continued Tuesday, July 24, 2012 at 1:30 PM in Geary County District Court. He will appear in court again on August 31, 2012 at 9 AM.

His bond has been set at $250,000. He is in custody in the Geary County Jail.

Officials say the gun Butler pulled on the deputy was stolen from a burglary in Manhattan.

According to the Kansas Department of Corrections' website, he was convicted in Geary County in 2004 on one count of Possession With Intent to Sell Drugs, Depressants,Stimulants, Hallucinogenics, etc. The site indicates that he was discharged in 2008.
