Emporia Woman Convicted Of Leaving Newborn In Dumpster

EMPORIA, Kan. (WIBW) - An Emporia woman was found guilty of attempted first degree murder Monday for leaving her newborn son in a dumpster.

The Emporia Gazette reports the verdict against Christina Devine was read at 5:30 pm Monday in Lyon County District Court. Jurors began deliberations earlier in the day, taking about six hours to reach their decision.

The Gazette reports prosecutors used their last chance before the jury to play the 911 tape of when the baby was found in the trash in October 2010. KVOE Radio reports prosecutors also pointed out that Devine passed several places where she could have taken the baby for safe care, including both Emporia fire stations and the police station, en route to the apartment complex where she put the baby in a dumpster.

Maintenance workers at an apartment complex heard the child's cries just before the dumpster was due to be picked up. The child survived.

The defense says Devine had flawed thinking from the trauma of twice being raped and a boyfriend's suicide.

Sentencing is set for August 10.
