(WIBW/Hiawatha World) - Proceedings for a wrongful death lawsuit in the murder of an Atchison County woman will stay in that county.

The Hiawatha World reports Judge Robert Bednar denied a change of venue request from attorneys representing Eugene Kimmi, Rebecca Hollister and Roger Hollister.

Patricia Kimmi's children filed the suit.

So far, Roger Hollister is the only person convicted in Kimmi's death.

A motion on a request for Judge Bednar to recuse himself for the case is set for Oct. 15. A trial in the civil suit is tentatively set for January 14th.
