TOPEKA, Kan. (WIBW) - The Kansas Court of Appeals Friday upheld a conviction in a 2009 Shawnee County kidnapping case.

Prosecutors say Jesse Dimmick was fleeing a murder charge in Colorado when he led Kansas authorities on a chase, then took shelter in the Dover home of Lindsay and Jared Rowley.

Dimmick was in the home for several hours before falling asleep, allowing the Rowleys a chance to escape. Dimmick was accidentally shot while being taken into custody. Dimmick filed a civil suit seeking $180,000 damages for injuries related to the shooting, but a jury ruled against him.

Dimmick is serving an 11-year sentence.

The Appeals Court denied Dimmick's claim that evidence was insufficient.
