EMPORIA, Kan. (AP) _ Charges were dropped Monday against an Emporia man accused of attempted second-degree murder.

The charges were dropped moments before jury selection was scheduled to begin in Dwight Swafford's trial.

After Lyon County Attorney Marc Goodman announced he was dropping the attempted second-degree murder charges, he said he planned to file battery charges against Swafford within the next three months.

Swafford is accused of shooting his girlfriend's son, William Calvert, at Swafford's home July 10.
