Judge to Allow Statement in Kan. Murder Trial

TOPEKA, Kan. (AP) _ A judge will allow jurors to hear an incriminating statement made to police by a man charged with stabbing a woman to death outside a Topeka community center in 1989.

A trial starts Monday in Shawnee County District Court for Theodore D. Netherland.

He is charged with first-degree murder in the death of Karen Estes. The case went unsolved for more than 16 years until the district attorney received two letters about it.

In 2006, Netherland told police that he had jabbed a woman with a knife outside the same center.

Netherland's attorney argued that his mental illness and below-average IQ prevented him from understanding his right to remain silent.

But District Judge Evelyn Wilson disagreed in a ruling Tuesday.
