TOPEKA, Kan. (AP) _ Prosecutor Phill Kline plans to ask the Kansas Supreme Court to let a key witness testify in a criminal case against an abortion clinic.
Spokesman Brian Burgess said Kline hopes to file his request Friday.
The witness is a Shawnee County district judge who once supervised Kline's investigation of the clinic.
The clinic is operated in Overland Park by Planned Parenthood. Kline, now the Johnson County district attorney, has filed 107 criminal charges against the clinic.
He alleges it falsified records and performed illegal late-term abortions. The clinic denies wrongdoing.
Meanwhile, the Supreme Court is attempting to resolve separate cases involving medical records from the clinic. It has told the judge he can't testify.
