The former attorney of a death row inmate will be allowed to speak in court about his former client's innocence.

Shawnee County District Court Judge Matthew Dowd ruled Thursday to allow attorney Dennis Hawver to give a deposition on behalf of 35-year old Phillip Cheatham. Hawver and Cheatham say Hawver did an inadequate job representing Cheatham.

Cheatham was sentenced to death more than two years ago for the 2003 shooting deaths of two women and the attempted murder of another. Cheatham and Hawver maintain Cheatham's innocence.

Hawver is scheduled to give his deposition May 2nd.
