A preliminary hearing is set for the man accused of accidentally shooting to death another emporia man.
32-year-old Ferman Hernandez made a first court appearance Tuesday. He's charged with involuntary manslaughter for the shooting of Alfonso Barajas in Emporia last month.
13 News radio partner KVOE reports Hernandez and Barajas were at a gathering in the 1400 block of East Logan when Hernandez says he fired the rifle at a bird, and Barajas stood up in the line of fire. Barajas was struck in the head and died.
A preliminary hearing for Hernandez to determine if there's enough evidence for him to stand trial is set for May 9th.
