Charges Upgraded In Bicycle/SUV Fatal

Topeka (WIBW) - A man involved in a two vehicle accident that left one person dead now faces a more serious charge.
Shawnee Co. District Court records show the complaint against Randy Ledbetter was amended from vehicular homicide to involuntary manslaughter.
The charges stem from a June 2009 wreck. At the time, deputies said Michael Anthony Ebron was riding a bicycle without lights or reflectors on Highway 24 near Goodyear Road. An SUV driven by Ledbetter overtook him from behind and hit him.
Prosecutors say Ledbetter was driving under the influence.
A preliminary hearing is set for March 19th.
Explanation of Charges
Involuntary Manslaughter
There are two statutes dealing with involuntary manslaughter. The first defines involuntary manslaughter as the unintentional killing of a human being, committed recklessly or in the commission of a felony other than an inherently dangerous felony, or during the commission of a misdemeanor enacted for the protection of human life. Involuntary manslaughter charges can also be brought in circumstances where a death occurs during the commission of a lawful act in an unlawful manner.
The sentencing guidelines provide for a range of sentence from 31 months to a maximum prison term of 136 months.
The second statute defines involuntary manslaughter as the unintentional killing of a human being committed while a person was operating a vehicle under the influence of alcohol, drugs or both.
The sentencing guidelines provide for a range of sentence from 38 months to a maximum prison term of 172 months.
Vehicular Homicide
Vehicular homicide is the unintentional killing of a human being committed by the operation of a vehicle or means of conveyance in a manner which creates an unreasonable risk of injury to the person or property of another and which constitutes a material deviation from the standard of care which a reasonable person would observe under the same circumstances. Simple negligence does not constitute a legal basis to charge Vehicular Homicide.
The maximum penalty for conviction of this offense is a jail term not to exceed one year and a fine not exceeding $2500.00.

So let me get this straight. According to Rhonda, God is now actively seeking out Drunk drivers to smite the lives of bicycle riders who have the audacity to think they can ride on the same road as a motor vehicle? Hold on, I think I feel a message being told to me by God, Ok He just told me to buy a gun, get plastered and go shoot people who look funny. Doesn't that sound completely nuts? I think so. While I'm at it why don't I just go out to the local prison and give free hugs to all the innocent people living there because they were wrongfully accused of breaking the law because God they were only following God's orders. This drunk driving dummy needs to stand up and take his punishment. Spend a few years in prison and think on why he ended the life of an innocent person and put the lives of children at risk.
How can any of you state that since this man is a good person that he shouldn't be accounted for his actions. If that was your family on that bike and he killed them, would you feel the same. Good people do bad things sometimes. No one is perfect. He should pay for his crime. Stop blaming everyone else and blame the one at fault. As far as the article reads, he was under the influence also. Again, this is ok? I don't understand people these days. Why is ok for one and not for another. There is a man that is dead, he can not defend himself but yet you are against punishing the man that did the crime. You can support him, but support his healing not his crime. One day it maybe someone you love that is killed.
dont know what happened here but can tell horror stroies about bike riders first they need to be restricted to roads that can accomadate two cars in the same place and enough room for bike rider, i live west of topeka and they are on k 4 and 99 all the time they ride two and three side by side and will not get into a single file when on hills and if you try to get around them you are most likely get the single digit sign one of these days their will be several people dead because of nerrow roads and the bike riders belife that they have the right of way all the time and the car or truck driver will get blamed for it if they would stay off of nerrow roads and show a little respect for other people on the roads then maybe accdents will be avoided
