Attorney General Files Addiitional Charges in Internet Pharmacy Scheme

LYONS, Kan. - Attorney General Steve Six announced charges Thursday against Hogan’s Pharmacy owners Jolane and Mark Poindexter for their part in an Internet pharmacy scheme. The pharmacist in charge, Rick Kloxin, was charged earlier this week.

Hogan’s Pharmacy in Lyons, Kansas, was shut down in March following reports of illegal and unethical behavior stemming from an Internet pharmacy scheme.

“Kansas pharmacies play an important role in protecting the health and well-being of Kansans,” Six said. “Most pharmacies take this responsibility seriously. It is absolutely critical that all pharmacies perform their duties ethically with the best interests of their patients in mind.”

After an investigation, both the owners, Jolane and Mark Poindexter, and the pharmacist were charged with one count Computer Crime (Level 8, Non-person felony), one count Conspiracy to Commit Computer Crime (Level 8 Non-person felony), one count Commercial Bribery (Level 8 non-person felony), seven counts of violations of the Pharmacy Act of Kansas (unclassified misdemeanosr), and seven counts of violations of the Kansas Food, Drug, and Cosmetic Act (unclassified misdemeanors).

The state alleges that the Poindexters and Kloxin distributed prescription-only drugs to people throughout the United States based upon questionnaires customers completed via the internet. The complaint alleges that the Poindexters and their pharmacist violated Kansas law by shipping the drugs without valid prescriptions, by not offering counseling to people how who purchased the drugs, and that the Poindexters offered and Kloxin accepted compensation for violating a duty owed to people the drugs were shipped to.

The Attorney General's office reminds the public, these are only allegations and Jolane and Mark Poindexter and Rick Kloxin are presumed innocent until proven otherwise in a court of law.

I realize that these folks are innocent until proven guilty, but Kloxin knew what he was doing was not right. He's been a pharmacist too long not to know that. Plus the Poindexters offered and Kloxin accepted compensation for violating the law. In another artical Kloxin was quoted that he was afraid to say anything because he was afraid of losing his job! Well now, not only does he not have a job, he has no license.
