Hall's Defense Accuses Prosecution of Withholding Evidence Save Email Print

OLATHE, Kan. (AP) _ Lawyers for the man accused of abducting and killing an 18-year-old Johnson County woman are accusing prosecutors of withholding evidence.

Edwin Hall of Olathe is accused of abducting Kelsey Smith, raping and strangling her.

Hall has pleaded not guilty to charges of capital murder, rape, kidnapping and sodomy. Prosecutors have said they will seek the death penalty if Hall is convicted.

Defense attorneys say the prosecution hasn't turned over videotape footage from the abduction scene outside a Target store in Overland Park in June. Part of Smith's abduction was caught on store surveillance videotape and broadcast nationwide.

A Johnson County judge ordered the video footage to be turned over.

A Johnson County prosecutor says his office is providing evidence to the defense as fast as it's obtained.
