Kansas High Court will not consider Schwab custody case

TOPEKA (WIBW)-- The Kansas Supreme Court will not consider the case of a couple who held Statehouse protests over the state taking their children.

Chief Justice Lawton Nuss issued the denial Friday.

Raymond and Amelia Schwab claimed their children were placed in state custody because of Raymond Schwab's use of medical marijuana.

A Kansas Appellate Court said earlier the children were taken because of neglect and Schwab's suspected drug use. The Schwabs say the findings were based on hearsay and violated his due process rights.

They've also filed a federal lawsuit against various state officials.
