Judge dismisses couple's lawsuit in child welfare dispute

(WIBW) - A Colorado couple says they are appealing a federal judge's decision to dismiss their lawsuit that the state of Kansas wrongfully removed their children from their home.

Judge Daniel Crabtree issued an order July 31st dismissing the civil rights lawsuit Raymond and Amelia Schwab and one of their sons filed against more than 30 defendants, including Gov. Sam Brownback and officials and staff with the Kansas Dept. for Children and Families.

Crabtree's order stated the Schwabs would pay the defendants' costs related to the suit.

The couple has publicly demonstrated against a Riley Co. Court decision to remove their children from the home in 2015, saying the state made false allegations.

Raymond Schwab told 13 NEWS they will appeal and will explore options with their attorneys for future litigation.

Schwab also said many of the people named in their lawsuit have been removed from their DCF case. He says they are in family counseling and return to court next week, to determine the next steps in bringing their children home.
