Suspect in late night chase cannot bond out of jail

TOPEKA (WIBW)- The driver involved in a late-night chase Tuesday in south Topeka is in a Shawnee Co. Jail and he cannot bond out.

Jail officials say a judge set bond for Nicholas Smiley at $30,000 for charges stemming from the chase, including aggravated assault, fleeing police, domestic battery, and drug possession. However, he is non-bondable due to outstanding warrants from the past two years involving similar charges.

Topeka police say an officer tried to stop Smiley, 36, around 11:30 p.m. Thursday night after spotting his vehicle, which had been the subject of an attempt-to-locate from earlier in the night, in the 2700 block of SW Burlingame. After a brief chase, Smiley ditched the vehicle in the 2000 block of SW Lincoln.

A K9 unit found him hiding in a garage about a block away.

He is due back in court on September 22nd.
