Topeka, Kansas (WIBW)- On Oct. 25th, 2009 at approximately 6:10 p.m., Riley County Police say the remains of a body were discovered near the 6300 block of S 32nd St. in Riley County, Kansas. That's an area about one mile to the northeast of the city of Ogden and almost two miles south of Manhattan Regional Airport.
Officers responded and found partially buried human remains.
You could hear a pin drop in the court room.... except for those speaking on the stand.... moments that both the accused and his family could not bare.
As the graphic photos of the two victims were displayed on a projector screen....22-year old Luis Aguirre kept is head down.
Aguirre is charged with capital murder in the deaths of 18-year old Tanya Maldonado and her 15-month old son, Juan.
Authorities say the two were killed sometime around September 19th 2009 and buried in a shallow grave near ogden in Riley County.
A hunter found their bodies October 25th 2009.
It is still unclear how the two were killed...the autopsy shows no signs of stab wounds..gun shots or perforations. Only evidence of animal activity.
Aguirre was arrested in Austin, Texas and transferred to Manhattan in early November.
As the investigation progressed....detectives learned that Maldonado had a previous relationship with Aguirre who had moved from the Chicago area to Ogden.
The family of the two victims was not in court Tuesday. As of March 2nd Aguirre has been bound over and will be arraigned March 22nd at 11:30am.
