Many Veterans returning home from Iraq and Afghanistan..... injured and sometimes permanently scarred ...are finding themselves facing divorce and child support legal actions.
And all across the United States these Veterans are also finding some judges and domestic court hearing officers.....unfamiliar with federal law.... are authorizing disability income to be included in divorce settlements.
It has been a major benefits battle for Navy Veteran James Monk, who says his disability pay cannot be included in his divorce settlement......and he hopes federal law 5301 will back his claim.
Now retired Veteran James Monk is engaged in a new battle....with the court system in Shawnee County.
Among other things, federal law 5301 states that disability compensation awarded to a veteran is for the vet only......it cannot be used for alimony, child support or any legal matters the veteran may be involved in.
The National Advocacy Group, Operation Firing for Effect helps veterans with cases such as these.
Firing for effect says Veterans have fought with blood sweat and tears....and this law which is for them must not be violated.
