The fence versus City dispute all started back in April of this year.

Jacky Bess was and is still being told by the city that her fence is too tall and needs to be lowered from 6 feet to 4 feet tall in the front portion of her home.

She has no problem lowering it to 5 feet but doesn't want to go any lower afraid her dogs may get out. If the dogs were to get out she would be fined $600 or more like she has been in the past.

"It protects me, my animals and the kids that go to school across the street. The dogs don't bite, but they scare the kids," says Ms. Jacky Bess, Home/fence owner.

Her concerned friend, James Higgins, says, "The city says she built the fence without a permit. The previous owner had the fence up already..and there is no permit necessary to extend it. I've got neighbors with fences that are higher. If a business can be protected with a tall fence why can't a home. This isn't the safest neighborhood."

"The fence is too tall. The code says it has to be 4 feet tall around the front of your home not allowed 8 ft fences around the front. The fence is fine on the side of the house and back, but not in the front. If she is found in violation the fence will come down. She can take it down or the city will. We have to prosecute in a way to take down the fence which includes jail time. Her attorney asked for probation instead. We do not intend on jailing her," says Dave Bevens, City of Topeka Spokesperson.

Jacky had her first court appearance Friday. She has 60 days to find an attorney in order to keep her fence at its six foot height. If you would like to help call James Higgins at 785-266-2284

What is good for one, should be good for all. Take a look at the first home south of 6th and California. Nice, clean, but still 6'. Topeka Code Compliance needs to set some priorities and it has to be better than safety fences.

Yes this whole thing is stupid, I live accross the street and had my van broken into last night and a stero stolen and you think the city is going to do anything about it, the cops wouldn't even come out and take finger prints or anything, but you better believe they(city) will come out and look at this fence that is too high, Topeka has got to be the dumest city out there, the cops don't do their job and when they do it half done

The City of Topeka needs to concentrate on their problems and leave this poor woman alone. She has done nothing to cause a problem for anyone else. In the neighborhood she lives in, her dogs not only provide companionship, but also security. Whoever filed this lawsuit needs to do find more to keep themselves busy, because obviously they don't have enough to do during their work day. The court should also be ashamed of themselves for allowing this case to go as far as it has. I say shame on the City official that is causing this woman these problems and shame on the court system for allowing it to go this far.

i dont live in topeka, but drive there often. I'd rather see the fences than i would the signs from "the cult" in topeka! Come on Topeka electeds.....you don't have real problems to contend with?

yes when was the last time the city took the phelps to court over their 6 ft privacy fence? you know I don't think that they have, why is that? How much money do they give to the city for them to turn the other way?

As stated before, if a dog that is friendly is provoked or injured it may bite. I think this lady should be honored instead of harassed by the city for being a responible dog owner.

I live next door to Mrs Bess and have 4 kids, I am happy that this fence is 6 ft so that the dogs won't get out. This lady follows all other rules and laws with trying to keep her dogs from getting out and bitting others and now the city has to try and find something else to complain about and try to get a little bit more money out of someone. She is on a fixed income and this would be a BIG issue for her to lower the fence and even more it would be a BIGGER issue if the fence were lowered to 4ft, then the city could fine her every other day for the dogs getting out, or worse take them away because they started the problem to begin with. How about the city drice around and cut grass, trees that are blocking stop signs and views of oncoming traffic...this city is getting bad, I think we as a city need to get these people out of office and then the city truly can start the rebuilding process until then, TOPEKA is doomed...

Thanks Jacky, for caring for the community more than our city officials. Have you ever thought of running for office? Maybe YOU would spend my tax dollar on gangs tagging PRIVACY FENCES, buildings, bridges, and homes. Or, you would spend it on drug dealers and junkies that get released, just to get on the streets to do it all over again. Heck, you might even spend it on proper drainage and street repairs to clean up the cess pool that this city represents. Please run for office, you'll have my vote, sister!!!!

When it comes to "rediculous", this takes the cake. Topeka needs to overhaul it's government. When a city has the per-capita crime of Topeka, stagnant growth even when the economy was booming, and a nightmare involving the fire department, why is time and money being wasted on someone's private fence. Please vote out the current council and mayor in favor of a government capable of prioritizing the utilization of taxpayer dollars, and creating a capital city that Kansas could be proud of.

David Bivens. get your head out of your butt (that's my opinion of you). Maybe even cleaning your eye glasses will help you open your eyes but I doubt it). I suggest that you clean up City Owned property before you worry about the home owner. Take some of your people that are getting paid taking down garage sale signs and put them behind a mower to take care of City Property such as weeds over a foot tall. Please don't waste my tax money on something as stupid as this fence deal. Don't make the city look more foolish then what it is already.

You have got to be kidding. the fence is there for a reason. At least she cares about her neighbors and people in her community which is more than I can say for the city so-called officials. the officials need to go to a psychiatrist for their narcissism. Maybe they should think about solving the murders in this town instead of picking on a lady who is trying to protect it.

I wish anyone with Rottweilers would get the highest fence that they can find. This is the most ridiculous thing a city could do, LEAVE THIS WOMAN ALONE. She has far more sense than the city. OBVIOUSLY. Not long ago at Milford KS, a little boy was killed by 2 Rottweilers as a bus load of students watched in horror and his brother, who crawled up a tree also saw it. The bus driver didn't try to help but that's beside the point. The owners of the dogs were prosecuted, if only there fence had been as secure as this woman's. However, perhaps the reason the city is acting irrationaly is because each time her dogs get out they gain $600. They make me sick with their lack of logic.

Vote them all out! My council person, Richard Harmon, already sees the writing on the wall and is applying for Judge Dowd's seat on the court. I hope that he doesn't get that seat, after all his judgemant as a city council member doesn't demonstrate clear thinking to me.

Leave the fence alone. The lady needs it for her dogs and her sense of security. Good, logical reasons. People who can afford it these days live in gated communities. How about that! A whole community fenced, and you never hear any complaints about that. But let a relatively poor person try to live in a secure way and she gets her hands slapped.

Worry about crime-reduction instead of fence-size, Topeka!!! Maybe then she wouldn't feel the need to put up a high fence. Prioritize!!! What a waste of tax-payers' hard earned money. All those council members down there, and not one of 'em can figure out the height of fences is the least of Topeka's image troubles.

This is ridiculous to even think she could face jail time for a fence. More importantly, however are the two facts stated in the article about her dogs and her security. The city government is not unaware of the fact that Topeka is not always the safest of places. She, as a tax-paying citizen should be able to protect herself and her property with a fence. Also, as a dog owner myself I completely understand her concern about dogs getting loose, and ending up with fines, if not worse, such as a lost or injured animal. Many Topekans talk about fencing issues with the city, and it's ridiculous. The city should worry about crime-rates, street conditions, and ways to improve the overall image of Topeka, not how high a fence is. That fence doesn't hurt looks nearly as much as the rundown parts of town do.

Our city needs to understand that this old lady is not only protecting herself but the children that go to school across the street. Can't we spend money on our rising criminal activity - like find the individual who stole my family boat and christmas decorations. Does anyone remember Sabine Davis from Fort Riley area or the KC boy who was biten by dogs. This owner is being responsible and what would the city do if the dogs got out and hurt someone (not that these dogs would)? Then she would be in even more trouble yet the city wants to fine and possibly jail her. LEAVE HER ALONE! The fence is kept up and not unsightly. Try finding my boat and decorations!

The property owner looks like the responsible one here. The city wants animals kept in a fence or on a leash - and she is doing that. The fence is tall, but not unattractive. This is governmental pettiness. They ought to leave the poor woman alone and take the money that would get spent prosecuting her (jail time!!! possible - like they are being compassionate by not asking for it) and fill a few pothole. This is the kind of harassment that makes the citizenry resentful anc cynical.

It all starts with the so called city council which is nothing more than a circus sideshow at best. I hope stories like this will get everyone out to vote these clowns out and start over,....a group of 5 year olds could run this city better.

I understand laws are laws. However, in this case, it is a fence that will protect her dogs, the children across the street, and the lady, because when she lowers that fence and the dogs get out and in the worst case, bite a little kid on their way to school, the city will be after her again for harboring dangerous animals. And I'm sure the city will forget why those dogs got out in the first place, because the fence was too low. I hope someone at city government reads these comments that the people of this city, their bosses, post. How about we redirect the responsibilities of the fence patrol, and the officials regulating the small business people who operate businesses out of their homes and garages to improving infrastructure. 29th street could be widened and proper drainage and streetlights installed. Not to mention traffic signals instead of another roundabout. Issues of traffic on Wanamaker could be addressed. Widening or at least a center turn lane and right turn lanes.

If my child was to attend school across the street from her, I would feel MUCH safer to have such a tall fence built esp with her dogs. Seems like you can never win. Build a tall fence and try to be safe, and then the fence is too tall!! No sense in making it smaller in the front portion of her house, then the dogs will know they can get jump on over on that side. WHAT'S THE HAZARD IN HAVING A 6 FOOT FENCE ANYHOW?

I so agree that this woman is being a responsible pet owner. It isn't an unsitely fence or blocking anyones view. There are however a lot of bushes and trees that block cross streets and stop signs and make it hard to see if traffic is coming. I think there is so much more that the city could do than bother this woman who is willing to lower her fence a foot if needed. Jail time for a fence? God help us!

This lady is thinking about her location near a school and her neighbors. Her concern is for the safety of her dogs and those around her. She has agreed to 5' and I don't believe she should be forced to lower the fence to that height. As several have noted, the fence does not obstruct the view and is there specifically for the safety of her dogs and her neighbors and the children attending the school. Let's move on to more urgent matters in our city and leave this lady alone. She is more civic minded at this point than the powers that be we have in this city. Maybe the first course of business would be to change the law about fences, as this one is outdated and archaic. How about a waiver for this lady!

What hope is there for the efforts put into the Heartland Visioning process if the city is going to waste precious $s on this foolishness? Topeka is doomed if officials insist on being so shortsighted. No wonder they have difficulty attracting companies that would provide high paying jobs! Who wants to listen to stories like this on the news about their home town! Topeka already has a world reputation as being a laughing stock because of our infamous picketers. The city is only reinforcing a blighted image by such ridiculous rules. And yes, I agree, it is scary as it sounds like the beginnings of a police state!

Good Grief!!! Leave the poor lady alone!!! You say she's in violation of some law....well, what about the city violating their own ordinance by NOT taking care of the abandoned lots etc!!!!!!! You have no room to talk, until you are n compliance yourself. Plus, this lady lives across from a school. It would be best for the fence to stay up. Its not blocking a drivers view! This is how stupid the city can be, just like the garage sale signs!!! I say....until the city can enforce ALL of the ordinances fairly....then quit picking on little ole ladies who are trying to do the right thing and not hurting anyone. Its not like this is a wood fence and the drivers view is blocked. GIVE ME A BREAK!!!!!!!!

RE your story on the fence: Every day in America we losing a little more of our freedom. This is how it occurred in Germany. We're going to jail someone over their fence! This is not only absurd, it's scary. I don't know who the man was who said the fence lady probably wouldn't go to jail. To jail! For what? And has to hire an attorney? It's gone too far when the so-called legal system is worrying about a fence. It's another reason to support the ACLU! And the city has this grandious idea that visioning will solve all it's problems. And this same city lets law enforcement kill people and get investigated by the same legal system. And you want me to believe all this? Perhaps, when I see Dorothy in the next rainbow.

I hope that Jackys neighbors support her in leaving the fence as is. Looks like her dogs are well cared for. Wonder who made the original complaint? It's not as if the lady had a 6 or 8 foot wooden fence there. Leave the lady alone. Thought the city was to busy pulling up yard sale signs to worry about a fence.

I totally agree. Leave the women alone. Why penalize a response pet owner? You want to go after someone how about people who are really causing problems for the city. My neighbors grass is about 6 foot high now but the our city government took away all funds to mow it. That is is someone being irresponsible not a women who is trying to keep her dogs in and away from the neighborhood children.

I have to agree. City has so many rules for dogs. Some rather stupid. This poor woman is making sure her dogs don't bother anyone. Leave her alone. I'd give anything to have a fence like that around my yard. If she lowers it to 4 feet and her dogs get out then she'll be fined again or worse. Gimme a break!

I could see the city wanting it lowered ir it was a privacy fence that you couldnt see into,but the fence looks fine.For the safety of the dogs and people walking by,leave her alone!I dont know what the expense would be to lower it but it cant be cheap.Leave the poor woman alone. She is probably on a fixed income and does not need this expense!Some idiot was just bored and needed something to complain about. Hey, city of Topeka, step up and let it go! There are a ton of properties that need to be cleaned up ,why dont you focus on that and leave this well meaning person be.

The fence looks fine to me, if i lived next door to them dogs id love that fence. Find something better to spend our taxes on than fightin someone over a fence. Most of the time laws make sense & are for the public good. Other times a law needs to be changed. Your story on the 6 ft. fence belonging to Jacky Bess caught my attention. Why, in the best interest of safety for our citizens, does the city insist on her lowering the fence 2 ft. instead of the 1 ft. she has volunteered.? I believe Jacky is showing concern for the children & her other neighbors by taking a firm stand to provide them protection from her dogs. Surely there are other situations within our Topeka neighborhoods that need more attention.
