TOPEKA -- The petition form to recall Shawnee County Treasurer Larry Wilson was approved by District Attorney Chad Taylor today. The District Attorney's review is limited to certain considerations, but must determine the sufficiency of the grounds. Notice of the approval was received in the office of the Shawnee County Election Commissioner Elizabeth Ensley Deiter at 2 o'clock this afternoon. The recall petition may now be circulated by the sponsors.
The grounds for the petition must be no more than 200 words and may only be for "conviction of a felony, misconduct in office or failure to perform duties prescribed by law." K.S.A. 25-4302
The sponsors have 90 days from the date that the recall committee receives the notice of sufficiency from the District Attorney. 90 days from today is March 12th, 2012. In order to recall Treasurer Larry Wilson, 31,395 signatures are needed, which is 40% of the number of total votes cast for the office of Shawnee County Treasurer in November of 2008. A list of the sponsors is available in the Election Office and will soon be available on the web site www.snco.us/election.
If the completed petition is found to hold a sufficient number of signatures by the Election Commissioner, the Treasurer is allowed a rebuttal statement of two hundred (200) words or less to justify his conduct in office. That statement will be a matter of public record and available for public inspection.
