Attorneys Pushes to Dismiss Road Crew Death Case

LAWRENCE, Kan. (AP) _ The defense for a 49-year-old woman charged in the hit-and-run deaths of two highway workers wants the case thrown out.

Ramona Morgan of Chewelah, Washington, is charged with two counts of second-degree murder for the September 11th, 2007, incident on U.S. 59 south of Lawrence. She was later arrested after leading authorities on a chase into neighboring Osage County.

She was convicted in April in Osage County of traffic violations linked to the chase.

Morgan's attorneys are arguing that because evidence in the murder charges was raised in the Osage County trial, trying Morgan on those charges would violate her constitutional protection from double jeopardy.

They also say prosecutors have not presented enough evidence to support second-degree murder charges.

Her trial is scheduled for September.
